By now everyone knows about retrogression.
Let's assume there will be no change in the quotas and you will have to wait for a long time; espcially because there is many labors from April 2001 - 245i candidates that were filed.
What to do?
Well, we also know that eb2 is retrogressed for india and china. However, there is more possibility of it moving forward faster because the worldwide category in eb2 is current. China and India will be able to use the spillover (unused visas by other countries) later this fiscal year, probably July to August 2006.
Now, most people who have been waiting here for years have more then 5 years of progressive experience so they would qualify for eb2. Trick is to make the position require 5 years of experience.
If you can get a perm labor approved in eb2, the priority date will obviously be 2005 or 2006. Therefore, most people who already have eb3 approved wouldn't think much of this option.
However, if you have two approved 140's you can transfer the priority date between eb2 and eb3. Therefore, let's say you have an eb3 140 approved with priority date in 2002. You get a perm labor in eb2 and approved 140 with a priority date in 2005 or 2006. You can request and USCIS will approve it, to transfer the priority date of your eb2 140 to 2002.
Now, you have just bumped up categories and moved yourself back three to four years in eb2.
Something to think about. As long as you can get an eb2 labor approved in perm, it will work. It may cost you a few thousand of dollars in filing it but to be able to move back three years it would be well worth it.
