我们的律师有问题吗?关于I-485

两天前从网上查到我们的I140已经批了,随后就得知排期的事情.我们想尽快在十月一日前把I-485申请交上去.可我们的律师说"For the month of September 2005, there is no visa number available for 3rd preference (your category). Therefore, you cannot file I-485. "
到底怎么回事,请明白人指点迷津.多谢啦!!
