H1 transfer confused

我想知道我现在是H4,今年8月1日辞职的,换为H4身份.现在又找了一分工作,公司要我9月19日上班,现在的H1申请还在律师手里,他说只要受到RECEIPT就可以上班了. 他说的对吗? 因为他是公司里的律师,不是专门的移民律师,我有点不放心.因为记得以前那位大侠讲过, 需要等到H1 APPROVAL 才可以. 我这算不算H1 transfer ? since there is one month gap inbetween two H1 ?
