My boy's H-4

My H1-B visa has been approved (I paid $1000 premiem fee and attorney fee for it because the university does not have any attorney). My hu*****and's H-4 was approved at the same time but there was no my boy's H-4. I asked my attoney yesterday and he said my boy did not need one. When I was wondering about it today he just called me saying my boy should get H-4 too but he did not receive any thing from Immigration agency.He also said he did file a petition for him but did not receive the receit. He will send another petition for my boy and I need to pay another $195 filing fee.My OPT will be expired on 08/22/05.I do not know when my boy's H-4 will be approved.Will this issue affect his status?
Any one with the same experience?
