EIC is not a public assistance.

However, EIC is a benefit only a US citizen or permanent resident can claim. (if you look at the tax form instruction on EIC, here PR should use INS definition, not IRS resident definition)
So, it really depends on whether the officer on your case wants to let it slide or not.
