I am currently in the process of PERM application. The company lawyer told me the prevailing salary was fine and it has nothing to do with the classifiction of EB2/EB3. He said I would be eligible for EB2 since the job required a Master's degree which I do have. Is that right although the prevailing salary looks low (less than 60K)? If so, what is the Labor Department's 4-tier salary used for?
