NIW Ref and H1

My I-140 was submitted 1.5 years ago, but got the ref. Till this month, but my h-1 will be expired the end of Aug., so would like to know from friends what I should do now, to apply for 485 although should take the risk for 140 denial, or extend H-1? My lawyer is not a very terrible one, but he promised to try his best to submit everything as soon as possible although everything became slow after he collected money. He even asked me to hold 485 till I got the news of 140 long time ago. So if I want to start my 485 application, I’d rather do it by myself this time. And can any friends also tell me how many stuff I need to prepare for 485 application? Many many thanks for any suggestions and comments.
