Am I eligible for NIW

Friends, I need some advice from you. I am currently woking in a private company, waiting for LC. As you know, it may take two more years for me get it.
Now, I am thinking if I can apply for NIW. I consulted some lawyers, some said yes, some said No. Here is my background.
3 journal papers, one is from the best journal in my field (civil engineering)
3 presentations at conferrence.
Ph.D
Ever worked for a State Department project and several local goverment projects.
Your advice will be highly appreciated.
