H1 Transfer and Re-Application

I got laid off last Month. My company would not invoke my visa status to INS for 2 Months but I haven't get pay check for about 1 month. Now I have an offer pending and some questions for those with similar experience:

(1) If My h1 transfer get rejected in US, can I go back China to apply H1B again? What could be the risk and will it be a new H1 to be capped?

(2) If I make visa interview appointment now, giving out my name, passport number and visa application category, will it effect my H1-B transfer in US?

(3) What kind of situation do you have to have to go back to apply for a H1 visa?

Any relevant experince sharing is appreciated
