Urgent: H1B status question?

I am taking maternity leave right now. I will get out of pay roll very soon. My employer can give 6 months vacation (without paid). But I am wondering if it is illegel to keep the H1B status, since I won't have the pay check for few months. By the way, my employer only gives two weeks paid vacation for maternity leave. Please give me some advice.
