背景： H1B 第一个6年已经用完， EB2/I140 已经去年 approved。现在的公司已经帮忙办理了新的H1B 延期（2019/8-2022/8）。 8月activated 后工作到现在。12月计划离开现在的公司，回去中国的公司工作。
8老师之前帮忙解答过，H1B延期approve 后，工作一段时间， 离职后再返回美国可以不需要新的H1B quote， 现在的问题是：有没有什么时间， 或者其他限制 继续使用原来的H1B。
-Yes, there is time limit. If your prority date is current and you don't file I-485 or apply for the immigrant visa within one year, the I-140 approval will be revoked and thus, you cannot use it to apply for the H-1 extension beyond the 6-year limit.

1.是否需要在2022／8月之前到美国，并且新公司需要在2022/8月之前submit H1B 申请？-Not need.因为当前延期是到2022/8 截止。 如果2022/8月之后submit H1B申请， 是否需要新的H1B quote。-No unless your I-140 is revoked because you don't file I-485 r apply for the immigrant visa. See above.
2 .新公司做H1B申请，是申请使用原来的H1B quoto, 这个申请还是有被移民局refer 或是refuse 的风险吗,假设公司，职务都没问题， 只是不allow previous quoto
-No problem. You can use the approved I-140 to apply for the H-1 by the new employer if the I-140 is not revoked yet (see above).
3. 12月离开现在的公司， 现在的h1B extension 多久失效？家属的H4 EAD 卡还能用多久？-When you leave US and not come back, your H-1 and your spouse's H-4 status will be void at the date you leave, i.e. your whole family need to leave US at the same time if you want to work in China.
