8老师好！我今年H1-B 9月底到期，现在申请了extension还只是收到了receipt, 已经交了EB2 的485 收到了receipt 但是工卡还没下来，现在排期也倒退了。

1. 请问如果9月底还没有出结果，我是否需要办加急才能继续合法工作？-Not need. You can continue to work for the current employer for up to 240 days after the current H-1B I-94 expiration during the H-1 extension pending.

2. 爱人现身份H1B 明年6年到期， 跟着我一起交了485，没有申请工卡，现在她想马上申请工卡用工卡工作，那么是否需要我拿到了H1B 的批准她才能申请成功？

-Not need. She can apply for the EAD any time as long as she receives her I-485 filing receipt notice.

也就是她的身份是否需要先转成H4? -Not need. 因为听说有人延期H1B 七个月才出结果，所以我是否需要马上加急H1B 爱人才能申请工卡？

3. 以后在绿卡面试时，如果延期H1B 还没有批准，身份属于GAP 状态，是否会对批准绿卡有影响？-No.
