具体情况是 I94  在4月1 日过期，雇主早在在二月份 就file H1B，但不幸6月5日被拒绝（也是这天就因此被lay off了)，
-From the date you did not work for the old employer (April 1?). Layoff (解雇) means you lost the job.


请问您说的60天还是按被lay off 这天(6月5日)开始算？还是按4月1日 I94过期这天开始？

-No any grace period in your case. Your situation is very serious now. because your I-94 expired (on April 1) and your H-1 transfer was denied, you have been unlawfully present (非法居留) from the date of your H-1 transfer denial, i.e. from June 5.  So, you must leave US as soon as possible. If you still stay in US for > 6 months or one year from June 5, 2017, then you will be subjected 3- or 10 year bar if you leave US. That means you will not allowed to reenter US within 3 years or 10 year.
