3月17日先生的工作被layoff，我和先生分开申请了同一个学校的F1,我的 F1 Cos已经批准并有I94。

先生收到了新的 H1b approval notice但没有I94，7月11日先生将带女儿离开美国去Vancouver办理新的h1b visa.

如果可以的话，先生只带女儿去，儿子留在美国境内转成我的F2。儿子跟着先生的F1 pending，这时取消先生的F1申请,孩子转成我的F2，会有什么负面影响？

-Technically, your son has no legally status since your spouse lost his job (if your son status was H-4 under his H-1) though your son is lawfull present with his F-2 pending under your spouse's pending F-1. So, your son can not change his pending F-2 or filing another new F-2 application under your F-1 status within US. Your son has to leave US to get the F-2 visa using your F-1 approval documents or to get the H-4 visa using your spouse H-1 approval documents.

我们还没收到这个信，是不是意味着先生的F1申请还算在pending状态？

-Yes, but once your spouse leaves US to get the H-1 visa, this pending  F-1 application will be void automatically. By the way, your spouse does not need to respond to this RFE.

(1)Will it be better my husband ask the college to cancel his F1 application before he visit the Vancouver Usa Consulate?

-Fine, it does not hurt anything to do it though it may not be necessary.  USCIS will deny it later, anyway.

(2)Once the College cancel my husband's F1 application. How about I get another I20 contect to my F1 for my son and submit the I539 for my son's F2?

-As I said above, your son can not do it within US. You can talk to your school about his F-2 visa application outside US under your F-1 status.

If the college can offer the I20 for my son, whether the Immigration Department will accept my son's COS in this situation?

(3)Will it be better wait until my husband leave Usa( his F1 application will be automatically cancelled by immigration department), then I ask the College to cancel my husband's F1 application, so as to release my son's F2 pending status in my husband's F1 case. And then add my son to be my F2?
