我的情况有点复杂, 身份基本情况: H1B明年5月底到期(用完6年), PERM申请材料已经准备了一年多了还没提交.
公司最近换了一位移民律师, 新律师在审核我的材料的时候发现上一位律师没有put swa job order, 律师目前给出的解决方案就是整个PERM申请材料重做, 最快也得3个月才能file perm. 我的H1B也只能等到140批下来再延期. 请问老师们, 除了公司律师给出的解决方案, 还有别的可行的方法吗? 谢谢!
-Your lawyer knows your case well, and may just follow the lawyer's suggestion. If your PERM is still pending before April 2017, I suggest you to take a vacation (pay or unpay leave) and travel to China bebore/in April 2017 to stop your 6-year H-1B clock. Thus, once your PERM is approved, then use premium to get the I-140 approved in 15 days, and then ask the employer to file H-1B extension for you to extend your H-1b beyond your 6-year H-1 limit (use premium processing also). Then, you can use the H-1 approval notice to apply for the H-1 visa to come back.
