我的OPT将于16年的8月16日到期，现在在申请H1B。如果H1B申请成功了，得要16年十月一号才能生效。这期间在美国能合法地呆吗？OPT到期后在美国停留六十天，是合法的吗？
-Yes if your H-1 is cap-subjected, i.e. sponsored by a company. If you have a job, your OPT will automatically be extended to Oct and thus you can continue to work as F-1 OPT. 1. So, at that time, ask your school International Student Office to make a note on your I-20 to extend your OPT and put the OPT extension information into SEVIS (no USCIS approval is needed).
