我妹妹现在是H1B，他的男朋友现在是OPT, 如何他们现在结婚

明年他男朋友回中国以OPT签证，会不会因为跟H1B结婚有移民倾向而被拒

-No. Irrelevant.

另外结婚后，如果不file I539的话，配偶的F1 OPT身份还是有效的吧，不会自动转成H4, 导致OPT invalid或不能延期吧？

-No. Only if she files I-539 to change status and get the new status approved or F-1 status expires, then her F-1 status can be void.
