我们的情况是这样的：

我是主申请人， 有H1B 和 EB3 2012年2月排期， I495pending 快一年了。 太太TN期间以配偶身份和我一起提交I485. 她的公司想今年替她申请h1B, 这样她的工作许可可以和我的申请进程分开。 有几个问题想请教一下。（我们都没有用过 EAD and AP.)

1。她的H1B申请会不会影响她的GC申请？
-No.

2。她们公司申请表中要change her status from TN to H1B,但她们律师不确定是不是会得到批准， 因为担心她TN staus已经不复存在。
-Do you mean her TN I-94 has expired? If so, the H-1 approval will have no I-94, and she needs to go to the border to activate the H-1.

即使H1B批准，依然可能需要出境激活H1B。出境会不会影响GC申请？
-Yes. Because her current status is not H-1, she can not leave US without AP.

担心到时刚好是排期到了。
3。她们公司要求附上EAD作为申请材料的一部分， 会不会导致EAD被激活？
-EAD application is irrelevant to the H-1 application. Application for EAD does not affect anything.

4。我的公司正在续期我们的EAD和AP， 可能会这个月提交。这些各种不同申请时间差不多会不会把出现问题或出错？
-No problem. If the H-1 approval has no I-94 (she does not take the risk to activate the H-1 in this case), she may just use EAD to work.

特别是排期这么接近的时候。
