回复：紧急求助H1B延期

请专家指点一下，我这种情况该怎么办？我的基本情况：

1）在学校做千老。下个月月底6年H1B到期。

2）NIW I140已经批了，去年12月的PD.

遇到的麻烦：

1）我这个工作的prevailing wage从前年的38k 涨到去年的70k，再涨

到今年的77k。我是幸运在去年这个prevailing wage以前申请的H1B

transfer。要是再延期H1b的话，只能从full time 转成成part time。

2）学校建议我搞O1A，个人觉得不够格，因为没review和awards，或

加入啥organizations。

 刚刚查了一下，发现学校搞visa的人用的是ACWIA的database 不是

all industries的database，学校到底应该用哪一个？用all industries

database我就不会有问题的，或者我换成另一个job category也不会有

问题。学校搞这个居然告诉我不可以换job catergory了。

请问：


1）搞part time H1B extension 会不会很risky？
-No.

part time会不会影响以后递交485？-No, but your employer needs to provide a letter stating that they will offer you full-time position after you get the green card for your I-485 filing.

2）听学校搞visa的人赶紧搞O1A？老板肯定不愿意交4000刀。ISS

charge 那么多刀。。。。并且没有保证能成。

3）我究竟可以不可以换job catergory？-Yes and many people like you do that to meet the prevail wage requirement for H-1 petition. The person in the school normally does not know the immigration law well.
