家里领导曾经是H1，9/30/2013满6年。


 

 因为layoff，转成H4，2月份批准。
 


 现在在找工作，如果6月份转回H1B，那么新的H1B是valid through 9/30/2013，


还是扣除4个月的H4时间段，valid through 01/30/2014?

-Yes, ask for it in the LCA and I-129 when filing the H1 petition. Provide the H-4 status evidence when filing I-129.


 

 7月份我应该可以交485，同时帮他申请EAD卡，乐观的估计，应该是10月份左右拿到EAD卡，所以这4个月的H4是否占用H1B时间还是需要知道的。
