i can't wait for my b1 extension approval because it will take couple of months. Can i submit the application and work with the company first?
-You can file the H1 application (B2 to H1) now during the B2 extension is pending, but you can not work until the H1 application is approved. Also, because your old B2 I-94 has expired (before you file H1 petition), most likely USCIS will not adjuducate your H1 application until they adjuducate your B2 extension application If your B2 extension is denied, your H1 application will be approved, but the approval will not have I-94 and thus, you need to go to China to get the H1 visa.
My education background is MBA and i had worked with an airlines company as a business analyst until October 2011 and, after that,I got back to China and worked with Chinese solar company as US market manager and i entered US in June 2012 with B1 visa.
i asked an attorney and was told my H1B can be transfered instead of reapplication because i have been in abroad less than one year. is it applicable?
-The lawyer is right and you can just use the left H1 time of your previous 6 year H1 time and do not need to get the new H1 quote.
