非常感谢8老师，但我又问了一个同学，根据他的说法所谓NON-CAP只是针对研究性的机构，并不是所有非营利性机构都可以申请NON-CAP，是这样的吗？

-He is right. Here is the three types of non-cap H1 spponsors/employers:

1. Institutions of higher education

2. Related or affiliated nonprofit entity connected to to a higher education institution,  e.g. through shared ownership, control or be somehow attached to the higher education institution as a member, branch or subsidiary.

Other types of non-profits, such as non-profit service, community, policy and arts organizations, do not qualify for the exemption from H1B cap. Unless the non-profit employer is primarily devoted to research, or is formally affiliated with a university, it will not qualify as a cap-exempt H1B petitioner.

3. Nonprofit research organizations or governmental research organizations
