目前状态： H1B, 2013年1月5号离职。离职package不是一次付清，一直发到5月份。目前有新工作面试，1月10号有面试。有可能被录用。 老婆H1B。
问题：
1. 如果不转H4,直接等offer来了H1b transfer, 是否会有身份gap.
-You need to provide the lastest paycheck stubs for the H-1 transfer, so if your current employer (old) does not inform USCIS to terminate your H-1, you should be fine for the H-1 transfer approval. If you do not have the paycheck stub (the payment history has gap) or your old employer ask USCXIS to terminate your H-1, your H-1 transfer will still be approved,, but the approval may have no I-94, thus you just need to go to China to get the H-1 visa to come back (no big deal, qanyway).
2. 如果转了H4，有了offer再转回H1B是否能马上开始工作？
-No, the H1 has to be approved to work in this case.
这种H1B是否还需要抽签?
