老师，我被大学LAYOFF，４月３０日最后一天工作日，５月３０日最后一张PAYCHECK，我的I－９４到八月，这种情况，我的H１B哪天过期？我现在找到大学的另一份工作，哪一天前我必须FILE H１B TRANSFER？在我H１B TRANSFER没批之前，配偶的H４算过期吗？谢谢 - You are considered OOS after 4/30, however if the employer files I-129 for you no later than a couple of weeks after your last paycheck, mostly your H-1B will be approved with I-94.

Your spouse is in status as long as you're in status, and needs to file I-539 prior to I-94 expiration upon your new I-129
