-Yes, you can, but the lawyer may not tell you unless he/she was hired by you (you paid the lawyer fee). But normally you can check the I-140 status online and assume it is not withdrawn yet. If it is withdrawn, USCIS will still approve your H1 for the left time of the 6 year H1 (e.g. 2 years). Then, you can use the new PERM/I-140 (from new employer) to extend the H1 again beyond the 6 year limit before your 6 year H1 expires.
