详情是这样。

1. 在A公司用H1B干了半年，跳B公司。

2. 在B公司用H1B干了三年半，期间：

一年后I-140获批。

三年后，延H1B三年。这样到终止日期累计H1B超过六年，不过因为I-140已批，没问题。

3. 在B公司三年半后跳到C公司，恰好排期到了。H1B转换只申到一年。但H1B累计只用掉四年，

还有两年可用。

我困惑的是，明明140是在B申请的，到C要重新办PERM，H1B转换时也只能延一年吗？

-If the approved I-140 from B is not withdrawn by B, you can use it to extend your H1 for another one year or three years (depends on PD current or not). If B withdraw the I-140, you can not use it to extend your H1 anymore. Thus, you have to have an approved I-140 form C to extend your H1 (using premium processing to get the I-140 approved before your current H1 expires).

我H1B还有两年才满呀。

-It is not the same as the 6 year H1 duration anymore. Every time you extend your H1 now, you have to provide the approved I-140 to be qualified for the H1 extension. Whether you get one year or 3 years depends on whether you rPD is current when USCIS make the decision.

如果我当时没告诉C的律师，B的I-140已批，是不是就可以拿到两年了？

-Not that case. Enven if the lawyer asked for 3 year H1 extension beyond the 6 year limit, USCIS would have only approved the H1 for one year because your PD is current when USCIS made the decision on the H1 petition.
