我的h1b从2007年10月开始。2008年11月被layoff了。2009年5月份的时候有个offer。然后2009年6月回国，8月份境外激活新的H1B. 刚刚接了个offer，在办h1b transfer. 现在的问题是, 这个recapture怎么算？
新公司的律师说我在2008年11月到2009年6月之间不能算在recapture之内。我提供了layoff letter。上面很清楚的写着我在被layoff公司的最后日期。但因为我是2009年6月才回国激活签证的，从11/08到06/09之间的日子不再美国境外，所以不能recapture. 是这样吗？
-You can argue with USCIS to recapture that period of time, but I am not sure whether you can get it because you did not change your status to another status or left US at that time to stop the H1 time running.
h1b到2013年10月就6年了，这次transfer h1b的时间上我没有优势。所以想能长点最好。
