朋友的先生2005年在美国大学毕业,有6年在美工作(CPA,税务)经验.他所供职的公司用第三优先,替他申请labor certificate,去年10月已经批准.这种情况,我们听说需要6年左右时间才可以拿到绿卡.

1)听说,象这种情况,可以以第二优先,申请labor certificate,和绿卡.请问是这样吗?

-Yes. Bachelor degree plus five years of working experience is qualified for the EB2 if the position has such requirment, but he needs to get the sponsor of EB2 I-140 from another employer. In other words, he can not use the experience he got from the same employer who sponsors his EB2 I-140.

2)现在应该怎么做才能最快时间拿到绿卡?

-See above.

是否应该cancel现有申请(用第三优先申请的东西),然后再用第二优先重新申请?

-Not need to cancel the EB3. The filing does not affect the EB3, but can use the EB3 priority date for the EB2 if the EB3 I-140 is approved.

3)他们必须只能通过公司的律师申请吗?可以自己指定律师吗?

-Depends on the employer and you.
