上周收到USCIS的RFE "...If you have not been a student while in H1B
status you may not be approved for F1 status as you will be over the
30 before the school start date."
我的情况是H1B今年9月中旬过期，在过期前递出了转F1的申请。I-20上的开始日期是明
年春季。我在今年秋季学期没有注课。
学校IO的人觉得我的F1很可能被据。不知道该如何是好，求建议。

要是最近找到博士后，由于身份也已经有GAP不知道，会不会也被据。
-Your H1 petition will be approved without I-94, and thus you just need to go outside US to get the H1 visa to ocome back to work. Use premium processing to get the h1 approved in 15 days and go to China or Canada to get the H1 visa.
