Can he submit his F1 TR application, mail it by overnight mail once know H1B extension is denied by checking online status)? Do you think this catches time?

because his perm is pending 9 months now, and don't want to give up the H1B in case perm is approved.

-As you said he still has 4 months of H1 left (pending h1), right? If so, he can extend it again for another one year using the pending PERM (filed one year before the h1 reaches the 6 year limit) after the pending H1 is approved (normally the H1 will not be denied). Actually he should have extended his H1 for one year plus 4 months using the pending PERM, not just 4 months, because his PERM was filed one year before his H1 reaches the 6 year limit.

So, my suggestion is that he does not need to change his H1 to f1 and just wait for the h1 approval and then, extend it again for another one year using the PERM.
