Only worked in total under H1B for 3 and a half years. Applied for Extension, but 律师错填成再延期. Received RFE from USCIS for the supporting evidence for my benefit of an entended H1B acrossing the 6 year limit. Do I need refile I-129 again? USCIS is definitely negative to let me cross the general rule of 6 year limit on H1B. 我还有救吗?!
-just ask your employer/lawyer to respond to the RFE that you do not qualify to extend your H1 status beyond the 6 year limit, and ask USCIS to extend your H1 to the date when your 6 year H1 limit ends. Nothing worried about and I am sure USCIS will approve your H1 extension petition to the date your 6 year h1 ends.
