Just check this article about "ITIN": http://www.irs.gov/individuals/article/0,,id=222209,00.html

It said:

"Individuals must have a filing requirement and file a valid federal income tax return to receive an ITIN, unless they meet an exception."

On my case, I don't know if my spouse match this requirement.
