ld是opt，和我一起交了485，现在准备申H1B，但是他们公司HR说这种情况不能在境内转H1B，

-The HR is wrong. Th eI-485 filing has nothing to do with the H1 petition (your change status from F1 to H1).

ld OPT8月到期，HR让用485based的EAD cover gap，

-Not true. You can just work from the OPT expiration date to Oct. 1 (H1 effective date) if you file th eH1 before your OPT expires, and this is the "Cap to Gap" rule for F1 to cap-subjected H1. Not need EAD to cover thh egap.

但是当时问了我的律师说是没问题，到底ld现在还能申H1B并且在美国境内转身份吗？
