H1B I797B visa application city

I got my H1B approval I797A last year after OPT. Then the attorney made a mistake and withdrew it and applied again a couple of month ago. USCIS approved and sent me I797B which does not have I94 at the bottom. The I797B says I need to go to Beijing for visa. If I change the consulate I need to file I824 form. The attorney told me that I could go to Canada to apply visa now and just forget about the I824 form. So my question is: Can I go to Canada to apply H1B visa WITHOUT filing I824 form? Thanks!
