urgent! work after file H1B transfer

My I-94 was expired 10 days ago and out of work a month ago. The new company lawyer told me that I can start to work immediately after you file my H-1B, even if I do not have a valid I-94 currently.Is that ture?

What if I get H1B approved without I-94? Is the work illegal during the pending period of time? If H1B is denied, is that ok?

The attorney also told me to use standard process (3 months) because it benefits me to have a longer processing time. Is this good for me or premium process?
