Hi, my case is a little difficult, I am afraid.

I started working using OPT. My company filed for H1b for me and got approved. But I lost my job in August while still using OPT. So actually I never worked as H1b. I also learned that my company withdrew my H1b later.

Now I got a new job. Can I still do change of status or they have to file a new h1b for me?
-The new company/employer has to file an h1 petition for you as the first company did and then change your F1 status to H1 with the effective date on Oct.1, 2010.
