-Why don't you apply for the J2 waiver within U.S. and continue your work with h1 in US at the same time?
Here are my questions.
1. Can I come back to US to visit my son and my hu*****and during these two years?
-Yes.
If yes, what kind of visa can I apply for?
-That is a problem.
My hu*****and is on H-1B.
-It may be difficult for you to get h4 visa because of the home resident service.
2. Is it legal if I still work for my current employer from remote?
-Yes. Immigration law can not control you to work in China no matter who is the employer (you do not need any US non-immigration status to work in China). You do not need to pay the income taxt to US Govermanent, but Chinese Government (if asked).
My current employer still wants to keep me working and would like to pay me as the same as when I am in US. Is that possible?
My 7th year H-1B will be expired in Feb 2011.
-When you leave U.S., your h1 is invalid automatically.
3. My EB2 priority date was November 2003. Will it still be valid when I come back to the same employer two years later?
-Yes.
