我的朋友目前是post-doc第三年，H1-B身份。他的H1-b身份是今年6月7号到期。三个星期前由学校的IPO 国际办（在麻省的学校）给递交申请H1-b 的延期。前天他收到学校国际办的email，通知他说他的H1-b不能办。原因是，波士顿的H1-B处理中心说他的salary太低了，不符合H1-B的审批条件。他目前的年薪是4万刀，这对一个post-doc来说很正常，而且他去年和前年的salary比这个还少，他申请H1延期也没碰到这个问题。

学校的IPO的办事员也说第一次碰到这个事。
-USCIS changed the prevail wage determination method in January 2010. The 学校的IPO的办事员 might not know this and make a mistake. You need to go to one of these websites to find the prevail wage:

If he find his cuurent salary is higher than the prevail wage, his H1 is OK. If not, he may change his job code to find a lower prevail wage to match his actual salary for the H1 petition.

He had better find a lawyer to help him out because I think the 学校的IPO的办事员 may have no experince.

1、有什么办法能让他在这儿维持身份？
-See my above suggestion. Another choice is to file a part-time H1 to keep the status. If he has no time, just use premium processing to get it approve within 15 days. If his H1 approval notice has no I-94 due to delay filing, he just needs too go out of US to get an H1 visa to come back. So, nothing worried.

2、如果转J1，他需要先回国然后再入境吗？
-He can do the H1 to J1 within US, but is not a good choice. I would rather file part-time H1, not J1.

一般H1 转J1要多长时间？
-2 to 3 months.

3、他申请了NIW的绿卡，140批了，还没递交485。这个对他有帮助吗？
-Irrelevant.

4、为什么Boston中心要据他？是不是有什么新规定了？还是他是第三年post-doc 工资要提高才能符合条件？
