我的H1B到2010九月底满三年. 我现在隶属于加州的一间小IT公司,但是作为consultant在康州为客户工作.

我的朋友讲,因为美国的就业市场很坏,我renew申请有很大的可能被拒绝.

我的PERM批准了,I140 is in processing.

我的问题是:
1. 我的朋友讲的是否属实? 被拒绝风险真的很大吗?
-It is true that USCIS is more strict in H1 processing, but it does not mean your H1 will be denied.

2. 如果是风险很大,那么有没有减少风险的举错?
-Talk to your lawyer and the employer to prepare the H1 application documents carefully and justify it details, and that will be fine. Not need to be panic because most of the H1 applications like yours are approved.

3. 假如被拒绝,我离开美国后,那么我的PERM和I140是否就作废了?
-No if you will work for the same employer later.

4. 假如以后我再持H1B来美国工作,是否还要重新申请PERM和I140?
-Yes if you will work in a different employer.
