H1b没有30/60 days的规定 - 回复：拿797B签H1B，签证的生效日期

1．我想知道哪天是我新H1b的生效日期。应该是我签证后二月下旬第一次入境的那天，对吗？

2．我如果现在file COS （H1B－>B1），移民局是不是会拒绝？
- probably, as you are OOS

因为我刚拿H1B入境说要工作，没几天就改旅游了。

3． 还有，我从去年11月底到今年2月28号之前一直领paycheck。这点时间没有H1B，以后要是申请绿卡，会有多大影响？
- H1b没有30/60 days的规定, so you being OOS for following periods:
1) 09年11月底 - 二月初
2) 二月下旬 - 四月上旬
3) 四月下旬 - present

the 1st two OOS will not affect you, but the last one does when it accumulates over 180 days.
