Urgent help on H1-B transfer

I got lay off last year, and find a new job. The new employer's HR told me, they are transfering my H1-B, so I start working for them. But untill now, the H1-B is still not transfered. The HR explained they made some mistakes etc, but I just checked, the check sent to INS still not been cashed and no receipt from INS. Some lawyers told me I am out of status and I have to leave US. Can someone give me some idea whta i shall do? Thanks very much for any advice.
