industry H1B to academia H1B

I am currently working in a company based on H1B (cap) , now I would like to work in academia. Should I file non-cap H1B petition? And after the petition is filed, can I change my work and work in academia? or should I need to wait unitil non-cap H1B is approved to be eligible to work in academia? Thanks for your kind help!
