我现在用H1B在工作，大约2月15日结束。 我已经提交了I485 （副申请人），拿到了AP和 EAD。我将在7月1日开始一份新工作，新的雇主马上会为我提交一份 H1B transfer petition （无限额的）。我计划2月上旬回国 （现在工作结束前，H1 transfer petition提交后），然后5月份用AP回美，再在7月1号开始用新的H1B开始工作，不知这样是否可行，
-No. If you use AP to come back, you only can work for the same employer before you leave U.S. without using EAD. If you work for another employer after you use AP, you have to use EAD and thus, you can not keep your H1 status. One solution is that you just leave US and use AP to come back to work for your current employer for a few days/weeks, and then do the H1 transfer, then you can keep your H1 status.
