I emailed the company attorney about the background security check, he replied that “The best way to minimize the chances of a problem occurring is to have immigration counsel assist you in preparing all the necessary forms and supporting documents and file a form G-28 (Notice of Appearance as Attorney) so that the Consulate knows you are represented by counsel. “
-I think your case may have been represented by your company attorney, and if so, your employer does not need to file another G-28 unless your employer wants to change the attorney. So check your HR.
1. Does anyone have experience about it?
2. Is it a good for H1-B out and re-enter USA? I don’t want to take risks;
-Whether you have attorney or not is irrelevant to the background check by USCIS. The attorney only can give some kind of assistance/advices if you have some legal trouble. In other words, your attorney can not reduce the probability that you will be checked by USCIS.
3. How long will it be valid? Do I need to apply for it every time?
-Once you/your employer hire an attorney to present you for your case, the attorney can present you all the time until the case is over or until you fire him/her.
