you last entered US on 3/12/08 and your I-94 was stamped for "until 12/30/07"? And thus "CBP said it is no problem with I-94"?

1) the validity period of previous H-1b : 06/2005 to 6/2008
2) the validity period of current H-1b, and approval date:
02/16/2007 to 02/16/2010 ; Approval date is around 2/14/07

3) your last admission date : 03/12/2008

I entered the States with H1 visa 2 years ago with H1B visa. This week , I will extend my H1B for another three years. However,I found my I-94 (last entry) with wrong stamp on the expiration from my old I-797 (till 12/30/07) from my previous employer. My current I-797 from current employer is expired on 02/12/10. I went to local CBP office. The CBP officer did not want to change the my error stamp on my I-94 (last entry to the States). Is it risky for me to apply for H1b extension? Any Suggestions?
