我有几个关于H1-B问题,我妻子的H1-B在2011年7月到期,现在已经用H1-B大约4年半了.公司在刚答应给办绿卡后被卖掉了,新公司不给办绿卡.我刚工作,绿卡申请也没开始.即使申请绿卡,EB1和EB2 NIW 也不适用于我.

我知道H1-B用到5年必须开始申请绿卡,现在看不可能了.
-Not really. You can use premium processing to get the I-140 approved within 15 days and then, file the h1 extension for another 3 years beyond the 6 year H1 limit.
我妻子是学会计的,有硕士学位.不知到怎样维持工作身份.
-She may find a company who agrees to sponsor her green card application. If she can not apply for the GC (PERM) one year in advance before the 6 year H1 expires, she can use premium processing to get the I-140 approved and then extend her H1.

1)我听说离开美国满一年,可以重新申请H1-B.是不是仅限于H1-B 6年用完后?
-No. Anytime you leave U.S.for one year outside US, you can get another 6 year H1 period when you come back.
我妻子的H1-B还有1年半的时间.如果现在回国,一年后回来是不是可以重新申请H1-B.
-Yes.
当然,我知道也要受名额限制,要取决于在在接近10月份时找到工作,而且H1-B还有名额.所以很困难.Non-Profit 公司也许可以试试.

2)离开美国满一年,是不是必须回到中国,去加拿大可以吗?
-Any country is OK.

2)H1-B 6年期限是不是也包括Non-Profit 公司?
-Yes.
我的意思是如果现在找到了non-profit 公司,H1-B是不是也被记做了4年半?
-Yes.

3)如果换个专业读个Master,可以申请另外一个OPT吗?
-No.
我妻子的OPT在读会计时用完了.印象中好像是不能,只能适用更高的学位 PHD.
-Correct.
