回复：急问pjiang小白兔老师, 用AP入境后485被拒,如何重新激活H1B?

请问pjiang小白兔老师及各位,我的情况和昨天agu同学的情况很相似,都是本来有H1B,可用AP入境后因为485 RFE没收到而485被拒,导致既没有EAD也没有H1B

.现在公司支持我回国重新激活H1B.可有几个问题想先请教您:
1. 我原来的H1B上的A#与刚刚被拒的485是一样的.这样的话签证官是否会查到我的485被拒而直接拒H1B呢?

是否应该让公司准备新的I-797?
-It is not necessary if your current H1 I-94 does not expire yet, but up to your employer.
2. 公司律师准备在我回国签证前火速递交新的Eb1-b,可是目前我没有任何合法身份.
我是否需要建议公司等我的H1B被激活后再提交?
-Not need. After you used AP, your employer still can file an H1 extension petition to re-instate your h1 status when you are physically present in U.S.
3. 公司律师说无法在美国境内激活H1B而必须回到中国,可我看到您博文中有好几处提到"境内激活"的说法,
-I do not think it will be a problem for you to re-instate your H1 by h1 extension if your current H1 I-94 does not expire. Also, you can just go back to China to get an H1 visa to come back to re-instate your h1 status.

能麻烦您解释下我的情况是否/如何能境内激活?
