回复:Pjiang Help! H4 and H1B Extension Problems.
I just got 1 year extension for my H1B, and my son and my wife got only 3 months extension for their H4 after 6 year H1b and H4. My EB3 PD is 03/2006, I140 approved and I485 pending. My lawyer called USCIS. The answer is "my priority date was current at one point in time (07/2007) they are not giving a 3 year extension.
-USCIS obviously made a mistake not to extend your H1 for three years.
For my wife and son they only gave 3 months
-They also need to extend your wife's H4 the same duration as your H1.
because your sons H-4 expires when he turns 21 and they give the same time to both applicants."
-They did the right thing for your kid.
Is it possible that I ask USCIS to give me 3 years H1B extension and my wife 3 years H4 extension?
-Yes. Contact them or go to USCIS local office to argue this issue. If it does not work, you may need to file the extension again before your status expires.
What kinds of reasons?
-See http://www.uscis.gov/files/pressrelease/AC21intrm051205.pdf

After my son turns 21 in December, what is his status?
-If he has filed I-485, his status will be AOS after his h4 expires. If he has not file I-485, he has to change his status to F1, etc.
can he still be given a green card when I get a green card after a few years later?
-If he has not file I-485 yet, you only can sponsor him green card using family based category after you get your green card or US citizenship.
