昨天被雷,现在正在准备转H4,律师给的材料LIST上说除了给USCIS寄一份I-539的材料,还要给 Kentucky Consular Center也寄一份,

谁知道需要给Kentucky Consular Center寄吗?
-That is for the Petition Information Management Service, known as PIMS which is required for H, L, O, P visa.

今天跟律师谈,我说公司愿意让我用unpaid vacation,然后过一个月再发最后一张paycheck.但是律师说实际上从昨天被雷,我已经out of status了,所以必须马上转H4,还要给Kentucky Consular Center寄一份材料,这样他们会加快处理我的申请,否则可能要出境转身份....
-Eevn if you are out of status as the lawyer said, so what? You are still lawful presence until your current I-94 expires. Also, you still can do your H1 transfer as long as you find a job within one to two months and get it approved with I-94 because USCIS is not strict in this issue. Finally, you can just visit China and get an H4 visa to come back before your current H1 I-94 expires and you have no problem to get the visa.

So, not need to be panic.
