H1 holder 自雇问题 is somewhat complicate. In your case, I suggest you to use EAD to work in your own company and that will be not a problem at all. The only thing you need to concern is that your new working area in your own company has to be the same/similar area as the one you indicated in your I-140.

请问有关H1B自雇问题：

1. I140已批，485PENDING期间，被LAY OFF,可否成立公司自雇？
-Yes.
2. 可否拥有股份并领取薪水，分红等？
-Yes.
3. 可否将H1B转入到自雇公司？ 如果被RFE 的话，可否由其他股东签有关雇用证明？
-Use EAD to work.
